Major Victory: Court Grants Stand Your Ground Immunity in Broward County Case
Rier Jordan is proud to announce a significant legal victory in the Broward County Circuit Court, where our firm successfully obtained a Stand Your Ground immunity dismissal for our client in a highly contested felony case.
Following an evidentiary hearing, the Court granted the defense’s Motion to Dismiss based on Florida’s Stand Your Ground law, finding that the State failed to meet its burden of disproving the client’s lawful self-defense claim.
The Case
Our client was charged with Second Degree Felony Murder, Attempted First Degree Murder (Firearm/Discharge), and Carrying a Concealed Firearm following a chaotic street confrontation that escalated into gunfire.
According to evidence presented at the hearing, the incident began as a verbal dispute between the defendant and another individual in the middle of a residential street. The situation quickly intensified when:
The other individual threatened violence.
Multiple armed individuals became involved.
Our client, who was initially unarmed, was punched and then saw others reaching for firearms.
Faced with what appeared to be an imminent deadly threat, our client reacted in self-defense during a rapidly escalating situation.
The Stand Your Ground Hearing
Under Florida law, a defendant can seek immunity from prosecution when the use of force is justified in self-defense. When such a motion is filed, the court must conduct a pretrial evidentiary hearing to determine whether the defendant is entitled to immunity.
At the hearing, the defense presented testimony and video evidence demonstrating that our client reasonably believed he was about to be shot or seriously injured.
The Court made several key findings:
The testimony of the State’s primary witness was not credible.
The defendant’s testimony was credible and supported by video evidence.
A reasonable person in the defendant’s position would have believed he was in imminent danger of death or serious bodily harm.
The Court also rejected the State’s argument that the defendant provoked the confrontation, noting that mere words or verbal arguments do not eliminate a person’s right to self-defense.
The Court’s Ruling
After reviewing the testimony, evidence, and applicable law, the Court ruled that the State failed to prove—by clear and convincing evidence—that the defendant was not entitled to self-defense immunity.
Accordingly, the Court granted the Motion to Dismiss based on Stand Your Ground immunity, ending the prosecution against our client.
